The present regulation [Regulation 24CFR 203.37a(b)(2)] that applies until February 1, 2010 states that a mortgage for a property will not be eligible for FHA insurance if the contract of the sale for the purchase of the property is executed within 90 days of the prior acquisition by the seller. In simple terms, flipped properties cannot be purchased with an FHA loan for the first 90 days. The waiver (planned for 1 year) allows for a lift in the 90 Day seasoning requirement thus opening up a broader market for home buyers.
The waiver will take effect on February 1st, 2010 but is limited to those sales meeting the conditions listed below.
Condition 1:
All transactions must be arms length with no identity of interest between the buyer and seller or other parties participating in the sales transaction.
Underwriters will be looking for the following:
1. Seller holds title to the property
2. LLC's, corporations, or trusts serving as sellers are operating in accordance with applicable state and federal law.
3. No pattern of previous flipping activity (multiple transfers) within the last 12 months.
4. The property was marketed openly and fairly, via MLS, auction, FSBO, or developer marketing
5. Any contracts with an "assignment clause" may be red flagged.
Condition 2:
Sales price of the property is 20 percent or more over and above the sellers acquisition cost, the waiver will only apply if the lender:
1. Justifies the increase in value by retaining the loan file supporting documentation and or a second appraisal wich verifies that the seller has completed sufficient legitimate renovations and repairs.
2. Orders a property inspection and provides the inspection report to the purchaser before closing. The lender can charge the buyer for the inspection. No other party can pay for the inspection besides the lender.

2010 Census to Begin
With the U.S. Census process beginning, the Better Business Bureau (BBB) advises people to be cooperative, but cautious, so as not to become a victim of fraud or identity theft.
The first phase of the 2010 U.S. Census is under way as workers have begun verifying the addresses of households across the country. Eventually, more than 140,000 U.S. Census workers will count every person in the United States and will gather
information about every person living at each address including name, age, gender, race, and other relevant data.
The big question is - how do you tell the difference between a U.S. Census worker and a con artist?
The BBB offers the following advice:
** If a U.S. Census worker knocks on your door, they will have a badge, a handheld device, a Census Bureau canvas bag, and a confidentiality notice.. Ask to see their identification and their badge before
answering their questions. However, you should never invite anyone you don't know into your home.
** Census workers are currently only knocking on doors to verify address information. Do not give your Social Security number, credit card or banking information to anyone, even if they claim they need it for the U.S. Census. REMEMBER, NO MATTER WHAT THEY ASK, YOU REALLY ONLY NEED TO TELL THEM HOW MANY PEOPLE LIVE AT YOUR ADDRESS.
While the Census Bureau might ask for basic
financial information, such as a salary range, YOU DON'T HAVE TO ANSWER ANYTHING AT ALL ABOUT YOUR FINANCIAL SITUATION. The Census Bureau will not ask for Social Security, bank account, or credit card numbers, nor will employees solicit donations. Any one asking for that information is NOT with the Census
Bureau.
AND REMEMBER, THE CENSUS BUREAU HAS DECIDED NOT TO WORK WITH ACORN ON GATHERING THIS INFORMATION. No Acorn worker should approach you saying he/she is with the Census Bureau.
Eventually, Census workers may contact you by telephone, mail, or in person at home. However, the
Census Bureau will not contact you by email, so be on the lookout for email scams impersonating the Census.
Never click on a link or open any attachments in an email that are supposedly from the U.S. Census
Bureau. For more advice on avoiding identity theft and fraud, visit www.bbb.org

Free Christmas Tree Recycling Greater Phoenix Area
Harvest for Humanity Foundation Announces 1st Annual Christmas Tree Recycling Program; Tree Drop-off Set for January 2, 2010 in Tempe
Phoenix, AZ – Harvest for Humanity Foundation, a non-profit foundation that farms vacant lots using natural/sustainable practices with community volunteers and donates the produce to the local Food Banks and shelters to help stop hunger, is announcing their 1st Annual Christmas Tree Recycling Program on Saturday, Jan. 2, 2010.
Residents all across the metro Phoenix area can drop off trees at 1006 E. Guadalupe Road,Tempe, Arizona, 85283 and recycle them for FREE on this date. Drop-off time is from 9 a.m. – 4 p.m.
The Christmas trees will be chipped on site by the donated services of Agave Environmental Contracting, Inc., and used in the mulching and composting program on site that assist in making this a more sustainable growing site that not only helps feed the hungry, but also helps giving back to the land.
“We encourage all those who celebrate the holidays with a live Christmas tree to participate in our recycling program,” said Denise Phillips, President and Executive Director of the Harvest for Humanity Foundation. “By recycling their trees, residents help give holiday trees a second life as compost or mulch.”
Harvest grows fresh fruits and vegetables which are distributed through food banks, prepared food service organizations, community centers, other non-profit organizations, and to numerous handicapped citizens (many of whom are children and elderly shut-ins) of Arizona.
To date, Harvest for Humanity has donated over 1,000,000 pounds of fruits and vegetables to local food banks, soup kitchens and care providers. Through community volunteer efforts more than 400,000 people are fed each year and more than 1,000,000 meals have been prepared using Harvest for Humanity’s produce.
